What is Mediation?

Mediation is an informal and confidential way for people to resolve disputes with the help of a neutral party. The mediator helps facilitate conversation, and drives the parties to constructive collaboration in resolving their disputes, the mediator helps the parties work out their own solutions to problems. Mediation in Massachusetts allows parties to collaboratively come to mutually beneficial and equitable decisions about their conflicts.

Benefits of Mediation

  • Avoids Litigation: The litigation process can be intense an involves pleadings, discovery, trial, and appeals, all of which can be costly in time, money, and emotions.
  • Productive Conversation: The parties are placed in a safe, controlled environment where they can work together, instead of against each other (as litigation promotes).
  • Faster: The mediation process can usually resolve a dispute in as little as one or two sessions (a couple of days) where litigation could take months.
  • Cheaper: Because mediation is a joint effort, the parties split the cost of mediation, and are able to avoid paying separate attorneys for an extended duration.
